TERMS AND CONDITIONS OF SALE

Welcome to Mulligans Collectibles! Please review the following Terms and Conditions carefully, as they govern your use of our website, our Discord services ("Binder Bot"), our API, and your purchase of products from us.

1. FINAL SALE POLICY
All sales are final. We do not accept returns, exchanges, or refunds, except in cases where an item was damaged during shipping.
If your item arrives damaged:
   a. You must notify us within 24 hours of confirmed delivery.
   b. Notification must be made by email to support@mulliganscollectibles.com and must include clear photos of the packaging and the damaged item.
   c. If reported within the time frame, we will assist you in filing a claim or replacing the item as appropriate.

2. PAYMENT TERMS
Payment is due immediately upon checkout unless otherwise stated. We reserve the right to cancel any order if payment is not received promptly.

3. SHIPPING POLICY
All shipping times provided are estimates and not guaranteed. We are not responsible for carrier delays, weather issues, or other unforeseen circumstances affecting delivery. Risk of loss and title for items passes to you upon our delivery to the carrier.

4. LIMITATION OF LIABILITY
We strive to provide accurate product descriptions and quality items. However, Mulligans Collectibles shall not be liable for any incidental, consequential, or punitive damages arising out of or related to your purchase or use of any products.

5. ERRORS AND OMISSIONS
We reserve the right to correct any pricing errors, typographical errors, or inaccuracies at any time without prior notice.

6. GOVERNING LAW
All transactions and agreements shall be governed exclusively by the laws of the State of Alaska, United States of America.

7. MODIFICATIONS TO TERMS
We reserve the right to update these Terms and Conditions at any time without prior notice. The version posted at the time of your purchase or use of service shall govern that transaction.

8. FORCE MAJEURE
We are not responsible for any failure to perform due to unforeseen circumstances, such as natural disasters, pandemics, labor strikes, supply chain interruptions, etc.

9. DIGITAL SERVICES (BINDER BOT & API)
If you subscribe to or use the "Binder Bot" (Discord App) or "Binder API" (Developer Service), the following additional terms apply:

   a. Service Availability & Third-Party Platforms
      i. Binder Bot relies on the Discord platform. We are not responsible for downtime, data loss, or service interruptions caused by Discord, AWS, or other third-party providers.
      ii. We reserve the right to modify, suspend, or discontinue any command or feature (e.g., specific game support) at any time without liability.

   b. Subscriptions & Billing
      i. "Binder Bot" Premium Plans and "Binder API" Base Fees are billed in advance on a recurring monthly basis. These are digital goods and are non-refundable once the billing cycle begins.
      ii. API Overage Fees: If you use the Binder API, you authorize us to automatically charge your payment method for any usage exceeding your plan's included limit. These charges are final and based on our internal logs.
      iii. Rollover Bank (Binder Bot): Unused daily scans that accrue in your "Rollover Bank" are a perk of active membership. If you cancel your subscription or your payment fails, any banked scans are immediately forfeited.

   c. License & Restrictions
      i. You may NOT: (1) share your API key with third parties; (2) scrape, reverse engineer, or resell our data; (3) use our services for any illegal purpose.
      ii. We reserve the right to ban any user, server, or API key immediately if we detect abuse, spamming, exploitation of bugs, or violation of these terms.

   d. AI & Data Disclaimer
      i. Our services use Artificial Intelligence to identify collectibles and estimate values. AI is not perfect.
      ii. Mulligans Collectibles makes no warranties regarding the accuracy of grading estimates, pricing data, or item identification. All data is provided "as is" and should not be used as the sole basis for financial decisions.

By placing an order, adding our Bot to your server, or generating an API key, you acknowledge that you have read, understood, and agreed to these Terms and Conditions.
